License Terms of Use

This License Agreement is a legal contract between you (the "Licensee") and Joël Bourgoin | As I Am Photography (the "Licensor"). By purchasing and downloading any content, you agree to the following terms, modeled after international stock standards and the Copyright Act of Canada.
1. Ownership and Grant of License
The Licensor remains the sole owner of the copyright. Upon full payment, you are granted a non-exclusive, non-transferable right to use the content based on the license tier purchased:
Standard License ($75 CAD)
- Web & Social Media: Unlimited use on platforms like Instagram, YouTube, and Facebook.
- Corporate & Small Business: Use on one (1) company website and internal presentations.
- Prohibited: No Paid Advertising (TV/Cinema), No Resale, No sub-licensing.
Enhanced License ($175 CAD)
- Full Commercial Rights: Includes all Standard rights plus Paid Advertising (TV, Cinema, Billboards).
- Unlimited Viewership: No restrictions on audience size or distribution volume.
- Nomadic Bundle: Purchases made under the $400 Bundle grant Enhanced Rights to all selected clips.
Editorial License ($60 CAD)
- News & Education: Strictly for non-promotional use in news, documentaries, or blogs.
- Prohibited: Cannot be used for any commercial or marketing purpose.
2. Moral Rights & Mandatory Attribution
In accordance with Canadian law, the Licensor asserts his Moral Rights. You must provide credit for every publication.
Required format: "Video: Joël Bourgoin | As I Am Photography"
Penalty: $500.00 CAD per occurrence for failure to credit.
3. Integrity of the Work
Content may be edited for length. However, major alterations that distort the artistic intent (heavy filters, AI generation, significant color shifting) are prohibited without written consent.
Penalty: $1,000.00 CAD for unauthorized alterations.
4. Prohibited Uses
- No use in any pornographic, defamatory, or unlawful context.
- No use in Logo/Trademarks.
- No resale of the clip as a standalone file (Stock-to-Stock).
5. Breach of Contract & Liquidated Damages
Statutory damages for copyright infringement under Canadian law range from $7,500 to $20,000 per asset. The penalties defined in this contract are deemed "liquidated damages" to avoid lengthy litigation.
